This analysis of the legislation is limited to the fundamental legal distinction between “Indian tribes” and a “foreign nations” under the US constitution and federal law with specific regard to the un-extinguished sovereignty of the Hawaiian Kingdom.

OPEN LETTER TO U.S. PRESIDENT BARACK OBAMA
'No' to Akaka Bill

We, the undersigned kanaka maoli (indigenous Hawaiians) kupuna (elders),
kumu (educators), and representatives address this letter to you on behalf
of our people and nation, as well as of other Hawaiian Kingdom heirs. At our
invitation, a number of our kako'o (supporters) have also added their names
to this letter.

Our primary purpose for contacting you, Mr. President, is to solemnly inform
you of our categorical opposition to the proposed legislation now before the

2009 POSITION ON THE AKAKA BILL - KEKUNI BLAISDELL

The Akaka Bill defines "Native Hawaiians" as "indigenous to the United
States," and, therefore, like American Indians and Alaskan Natives, wards
in/of a domestic dependent nation under the plenary power of the US
Congress. We object strongly to that language and implications. We Kanaka
Maoli are not indigenous to the US. The Akaka Bill purposefully puts us in
this category of "indigenous people" subject to the rule of settlers who
control our country. While we refuse to be so categorized, we are
indigenous to our homeland, Ka Pae'aina Hawai'i.

Claims: Native Hawaiians are relinquishing everything.

--Act does not create cause for action against the US or the State of Hawaii, or altering laws, obligations.
--Act does not create obligations that did not exist prior to this Act

--Act will only recognize the NH Governing Entity as representing the Hawaiian People

--US has sovereignty immunity against any "breach-of-trust" land claims, etc.

SECTION 1. SHORT TITLE.

This Act may be cited as the `Native Hawaiian Government Reorganization Act of 2009'.

SEC. 2. FINDINGS.

Congress finds that--
(1) the Constitution vests Congress with the authority to address the conditions of the indigenous, native people of the United States;
(2) Native Hawaiians, the native people of the Hawaiian archipelago that is now part of the United States, are indigenous, native people of the United States;
